The lead witness in a death penalty murder trial goes missing, so DA Gail Walsh enlists the help of NCIS to find him before the judge grants a mistrial.
The accused is Franklin Hayes, once a private investigator who lost everything, mugged a brother and sister in an alley and ended up killing the sister.
They interview Matthew Gray, brother of the victim, who implores our team to find Jerry. NCIS tracks down Jerry, the witness, who went into hiding after receiving a threatening DVD.
Gibbs suspects that Walsh is hiding something and decides not to tell her that they’ve located her star witness. Visitor logs to our suspect indicate that Hayes been meeting with a Smitty Brown, a dealer who wants to keep Hayes in prison.
He was going to use Hayes in prison to help run his black market drug and weapons dealing. Smitty wanted to stop whomever was harassing Jerry and ran into Joe Casey, they guy who made the threatening video to Jerry.
Smitty claims self-defense when Casey shows up dead.
Jerry, while still in protective custody at NCIS, is driving everyone crazy with his ability to accurately breakdown everyone’s life.
Walsh was actually hiding the fact that Smitty was her informant and they shared an intimate relationship. But the person behind harassing Jerry was none other than Matthew Gray.
He wanted the judge to grant a mistrial so that Hayes would be set free. This way Matthew could avenge his sister’s death by killing Hayes himself.
While all this is happening, Tony is not acting like his normal self, due to a reexamination of his priorities, which concerns Ziva and McGee.

Next week would be the Holiday episode of “NCIS: Naval Criminal Investigative Service” and “NCIS: Los Angeles” but crime doesn’t take a holiday. In the former show, the NCIS team investigates the disappearance of a Navy petty officer who is the sole witness in an upcoming murder trial.

“False Witness” presents a dead turkey that the victim hunted when he was murdered. It becomes the team’s only link to find out what happened in the woods. Speaking of the episode which mood is lightened up, co-executive producer of the series Steven Binder who wrote the episode said, “Let’s just say that Tony DiNozzo will be behaving very differently from what we’re used to.”
Meanwhile in “NCIS: L.A.”, Kensi connects personally with a discharged Navy Intelligence officer suffering from post traumatic stress disorder who is the sole survivor of a deadly dispute being investigated by the NCIS team. “Disorder” airs right after “False Witness” on December 14.
NCIS star Michael Weatherly will pull double duty later this season as he makes his directorial debut.
“I like cameras and I like sets and the surgical nature of make believe that happens — the whole process,” Weatherly tells TVGuide.com. “I love all aspects of production, and I have a great deal of respect for the whole craft. I’m really excited about directing; it’s an extension of my curiosity about film and TV.”
Weatherly expects to go behind the camera for an episode filming in January. He says the crew may also document his directorial experience for a special feature on the forthcoming Season 8 DVD.
Weatherly, who has made known his desire to direct for some time, says his curiosity about filmmaking began when he was a cast member on the ABC soap opera Loving. “I think that was always fascinating to me,” he says. “When I was on the soap opera, I’d sit in the editing booths when they’d tighten up the show to see how they did that and what the technical process was. I probably should’ve started getting into the technical side of it earlier.”
Although a CBS rep confirms that Weatherly will helm an upcoming episode, no other details about the episode were immediately available. But Weatherly — whose character, agent Tony DiNozzo, is known for his trademark sense of humor — promises the episode will stand out.
“I’ve got a lot of ideas about my version of NCIS,” he says. “I can promise that it will be a little bit different. It’s daunting to imagine that I am going to be running around in charge.”
And Weatherly, who likes to cut up as much as his character, says his co-stars are in for a ride. “Everyone is terrified,” he jokes. “Sean Murray [McGee] is probably most terrified because I have got a lot of acting notes for him.”
Weatherly, 42, has starred on the hit CBS procedural for all eight seasons. He signed a multi-year contract extension earlier this year. NCIS airs Tuesdays at 8/7c on CBS.

Former Melrose Place star Thomas Calabro, who just signed on to appear as a murder suspect on Castle, will also appear in a January episode of NCIS, TV Guide reports. He’ll play Sam Feeney, a charismatic businessman who runs a high-end billiards club, and a former military officer tough enough to handle the regulars who get out of hand. Good to see Michael Mancini’s keeping busy these days. Should be a fun episode to watch.
